Terms and Conditions of Use of Trade Marked BHO logos

Set out below are the terms and conditions under which you are licensed to use the BHO trade marks.

By paying for and being eligible to use a BHO trade mark, you accept these terms and conditions.

  1. You acknowledge that BHO trade marks are owned by BHO and are used by you under licence.
  2. You must only use a BHO trade mark in relation to the sale of property or a business by the Buyer’s Highest Offer method as described by BHO in their e-publication available through the BHO website. You cannot use a BHO trade mark in relation to any other goods or services.
  3. You must only use a BHO trade mark in the format and in the manner as specified by BHO.
  4. You must not:
    • a. Make any changes to the BHO trade marks other than change the colour of the logo.
    • b. Register or apply to register or use any other trade mark or name which is the same as or deceptively similar to any of the BHO trade marks.
    • c. Use any of the BHO trade marks in a manner which might adversely affect the goodwill or reputation of the BHO trade marks.
  5. You must:
    • a. Comply with the format and manner of use of the BHO trade marks.
    • b. When using the BHO logo, display the licence number issued with the logo alongside / close to the logo.
    • c. Include a footnote in any promotional flyer regarding the sale of your property by the BHO method that you are not associated with BHO, do not represent BHO, and cannot bind BHO in any way.

    If requested by BHO's solicitors, provide examples of all use of the BHO trade marks by you.

  6. You cannot:
    • Use a BHO trade mark to sell property on behalf of property owners and charge fees for such a service.
    • Carry on a business relating to the sale or leasing of property or the sale of businesses using the BHO sale system and logo.
  7. The licence to use the BHO trade marks can be terminated if you are in breach of these terms and, in the case of a breach which is capable of being remedied, you fail to remedy the breach within 30 days of written notice of the breach.
